2. WHO IS RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA?

MONDIANA will be considered the CONTROLLER of personal data in all situations where it fits the legal definition of the LGPD, i.e., when it is responsible for decisions regarding data processing.

 

As a service provider, in cases where it does not have control over personal data processing activities, MONDIANA will act as the “Processor” of the personal data of the clients of the said “Controller” company.

 

When MONDIANA acts as the PROCESSOR, the data subjects’ data will be processed and stored in the CONTROLLER’s systems that operate in accordance with security policies and mechanisms, specific contractual clauses related to privacy, and personal data protection.

 

As a CONTROLLER, MONDIANA may process personal data and sensitive personal data in situations authorized by Article 7 and Article 11 of the General Data Protection Law, such as to comply with a legal obligation, for the execution of a contract, or for the regular exercise of rights.
